Tenant Evicted for Unpaid Rent, Despite Bankruptcy

LVT Number: 15568

(Decision submitted by Sabrina B. Kraus of the Manhattan law firm of Borah, Goldstein, Altschuler, Schwartz & Nahins, PC, attorneys for the landlord.) Landlord sued to evict tenant for nonpayment of rent. Tenant claimed that landlord couldn't go forward with its case because he had filed for bankruptcy. The court ruled against tenant. While the bankruptcy court ruling stopped tenant from having to pay back rent, it didn't prevent landlord from evicting tenant based on the unpaid back rent.
