Tenant Entitled to SCRIE Benefits

The City of New York denied tenant's application for SCRIE benefits. Tenant appealed, claiming that the decision was unreasonable. The court and appeals court ruled for tenant. The city had argued that it could deny SCRIE benefits to tenant, since there had been no recent increase in tenant's legal regulated rent. But tenant currently came within SCRIE eligibility guidelines and so was entitled to benefits.
