Tenant Doesn't Prove Housing Discrimination

Tenant sued the NYC HDC, landlord, and the NYS Freedom of Information Law office in federal court, claiming housing discrimination. Tenant stated that he was a disabled veteran, a senior citizen, and a person of color. Tenant moved into his building in 2004 at a monthly rent of $1,854. At various times he sought a rent reduction, to no avail.  HDC, landlord, and the FOIL office asked the court to dismiss the case. They pointed out that tenant's prior discrimination claim, filed in state court, had been dismissed.

They pointed out that tenant's prior discrimination claim, filed in state court, had been dismissed. Tenant's prior action in state court against the defendants didn't bar the present action, because tenant hadn't claimed racial discrimination in the prior case. But tenant presented no facts that showed any discrimination or wrongdoing by any of the parties sued.  The case was dismissed.
