Tenant Didn't Provide Access for Painting and Repairs

Rent-stabilized tenant complained of a reduction in services. The DRA ruled for tenant and reduced her rent based on findings that the apartment needed painting and plastering, there were water leaks in various rooms, the window in one bedroom was off track, and the windows in the living room had peeling paint. Tenant later complained that landlord hadn't complied with the portion of the DRA's order directing repairs. The DRA ordered a "no access" inspection. Landlord and its workers appeared, ready to make repairs. But tenant refused access.

Tenant later complained that landlord hadn't complied with the portion of the DRA's order directing repairs. The DRA ordered a "no access" inspection. Landlord and its workers appeared, ready to make repairs. But tenant refused access. The DRA therefore granted rent restoration to landlord. Tenant appealed and lost. The DHCR's inspector reported that landlord was prepared to do the work at the time of inspection. Tenant wanted landlord to use her paint, not landlord's paint, but didn't have enough paint to cover the nine-room apartment. Tenant also hadn't moved furniture to provide access for painting. The DRA properly restored the rent under these circumstances.
