Tenant Didn't Complain About Hot Water

Tenant complained of a reduction in services based on inadequate heat. An inspection showed inadequate hot water. The DRA ruled for tenant on this basis and reduced his rent. Landlord appealed, pointing out that tenant didn't complain about hot water. The DHCR ruled for landlord and revoked the rent reduction. It was improper to conduct an inspection for hot water and then reduce tenant's rent on this basis when tenant hadn't complained about it.
