Tenant Didn't Complain About Fire Damage Until After She Resumed Occupancy

Tenant complained of a reduction in services, as she had to move out of her apartment temporarily because of a fire in December 2004. The DRA ruled against tenant. Tenant appealed and lost. Tenant claimed that her rent should be reduced to $1 per month for the period when she was out of the apartment. The DHCR said tenant didn't file her complaint until April 2005, after she had moved back into the apartment. By that time, the services had been restored, so there were no grounds for her complaint.
