Tenant Didn't Complain About Bedroom Door

Tenant complained of a reduction in services based on damage from moving a refrigerator. An inspection showed that there was a problem with tenant's bedroom door. The DRA ruled for tenant and reduced his rent. Landlord appealed, claiming that tenant didn't complain about the bedroom door. The DHCR ruled for landlord and revoked the rent reduction. Tenant's complaint wasn't clear as to which rooms were damaged during landlord's refrigerator delivery.

Tenant's complaint wasn't clear as to which rooms were damaged during landlord's refrigerator delivery. Tenant's prior letter to landlord, attached to the complaint, stated that workmen had gouged the divider between the kitchen and dining room and considerably damaged the walls and doorways. Tenant's complaint stated that the bedroom doors were banged up during the delivery. The DHCR inspection found only that the bedroom door didn't fully close and didn't properly lock. No other defects were found. This was not the condition that tenant complained of.
