Tenant Didn't Abandon Loft

Landlord asked the NYC Loft Board to determine that tenant had abandoned his loft, so that landlord could remove the unit from Loft Law protection. The Loft Board ruled against landlord. Landlord appealed and lost. The Loft Board’s decision was rationally based on New York City law. Tenant left at the end of his month-to-month lease term and was in good standing at that time. This wasn’t abandonment.
