Tenant Denied Access for Repairs

Tenant complained of a reduction in services. The DRA ruled for tenant based on findings that the fire escape had peeling paint and was eroded, the balcony ceiling had peeling paint and water blisters, and the balcony railing was eroded. Landlord appealed. Landlord had told the DRA that tenant refused access on two occasions. Landlord had requested a ''no access'' inspection from the DHCR, but the DHCR then conducted two inspections without the required notice of inspection to landlord. The DHCR ruled for landlord. Copies of landlord's letters with proof of mailing were in the DRA's file.
