Tenant Denied Access for Painting

Tenant complained of a reduction in services because her apartment needed painting. The DRA ruled for tenant and reduced her rent. Landlord appealed and won. Landlord contacted tenant in November 2005 to request access for painting. Tenant asked landlord to wait until after the holiday season. In January 2006, tenant again said she wasn't ready and wanted the painters to work on a weekend. Landlord's contractors weren't available then. The DHCR revoked the rent reduction. Tenant admitted that she didn't let landlord paint in November, nor again in January.

In January 2006, tenant again said she wasn't ready and wanted the painters to work on a weekend. Landlord's contractors weren't available then. The DHCR revoked the rent reduction. Tenant admitted that she didn't let landlord paint in November, nor again in January. Landlord also showed that it sent tenant a certified letter requesting access for repairs. Tenant didn't accept delivery of the letter. Since tenant didn't provide access, her complaint was dismissed.
