The DHCR ruled for landlord. Initially tenant delayed access for painting because a pipe leak had been repaired and the wall needed to dry. The DRA's inspector visited the apartment before the rescheduled access date. The rent reduction was based on this inspection report. Landlord shouldn't be penalized for not painting before the rescheduled access date.
