Tenant Consented to Rent Increase

Landlord filed with the DHCR a notice of a rent increase to rent-controlled tenant based on individual apartment improvements costing $2,500. This resulted in a monthly rent increase of $62.50. Tenant had signed the consent portion of the notice. The DRA approved the rent increase. Tenant appealed. The DHCR pointed out that the DRA's notice of disposition of landlord's filing wasn't an order that was subject to appeal. So tenant's PAR proceeding was terminated.

If tenant disputed the rent increase that resulted from the consent form she signed, she should file a rent overcharge complaint.
