Tenant Claims Property Damaged During Wrongful Eviction

Tenant sued landlord for assault and battery, emotional distress, and illegal disposal of his property in connection with an unlawful eviction. The trial court awarded tenant $7,500 for wrongful eviction. Tenant appealed, claiming that this amount was inadequate. Tenant claimed that landlord owed him more money for property damage. The court dismissed tenant's appeal. Tenant had been given many opportunities at trial to itemize his losses but hadn't done so.
