Tenant Claims Errors on RN-26 Form

LVT Number: 18702

Rent-controlled tenant complained of a rent overcharge. Tenant claimed that landlord didn't send her MBR increase notices for 1991, 1992, or 1993. The DRA ruled for tenant in part. Landlord had filed the 1991 RN-26 form, but no form was filed for 1992--93. Tenant's legal rent was $628. Tenant appealed, claiming that the DRA incorrectly calculated her legal rent. The DHCR ruled against tenant, finding no errors in the MBR rent increases calculated on the RN-26 forms.
