Tenant Claims Defective Windows

Tenant complained of a reduction in services based on broken casement windows that wouldn't close. The DRA ruled for tenant, and landlord appealed. Landlord had replaced the casement windows with new thermal double-hung windows before the DRA's inspection. Therefore landlord had no notice that there were any defects in the new windows. The DHCR revoked the rent reduction based on this condition.
