Tenant Caused Mold and Mildew Condition

Rent-controlled tenant complained of a reduction in services. The DRA ruled for tenant and reduced her rent based on two conditions found in tenant's apartment. Tenant appealed, claiming that, in addition, there was a mold and mildew condition in her bathroom. The DRA gave her no rent reduction for that condition. The DHCR ruled against tenant. The DHCR's inspector found that the mold and mildew condition was caused by tenant's failure to clean the bathroom. There was no proof that it was caused by landlord's failure to paint the outside of the building or by other building conditions.
