Tenant Can't Stop Eviction

LVT Number: 16166

Landlord City of New York sued to evict tenant. The court ruled for landlord and issued an eviction notice. Tenant then sued landlord to stop the eviction. Tenant claimed that the tenant's association, as manager of the building under a Tenant Interim Lease Agreement with the city, had created a new tenancy with tenant. The court ruled against tenant. Any agreement by the tenant's association to allow tenant to remain in the apartment was in violation of the association's bylaws and, so, was invalid.
