Landlord NYCHA terminated a tenancy after tenant failed to appear at a hearing. NYCHA had charged tenant with chronic nonpayment of rent and violation of a probationary agreement to pay on time. Tenant filed an Article 78 appeal, claiming that NYCHA’s decision was unfair. The court ruled against tenant. Tenant claimed that he had a valid excuse for not appearing at the NYCHA hearing because he had to appear at a transit hearing. But he had no meritorious defense to NYCHA’s charges. The court ruled against tenant.
