Tenant Agrees to Reduction in Apartment Space

Landlord asked the DHCR if the size of tenant's apartment could be reduced. In an opinion letter, the DHCR stated that if tenant in occupancy was being asked to give up 25 square feet from his apartment, and tenant agreed to the reduction in space, landlord must apply to the DHCR to reduce tenant's space. Tenant would be entitled to a rent reduction. Tenant wouldn't be entitled to regain the space given up. A subsequent tenant would also be bound by the reduction in space and the rent reduction would remain in place.
