Tenant Acknowledged Apartment Conditions Were Adequate

Tenant complained of inadequate heat. The DRA ruled for tenant based on an HPD report that showed that the temperature in tenant's apartment was 64 degrees, while the outside temperature was 32 degrees. Landlord appealed. HPD had gone back to tenant's apartment five days later and issued a second report, stating that tenant wouldn't give access, but acknowledging that the heat was adequate. The DHCR ruled for landlord and revoked the rent reduction.
