Temperature Above 55 Degrees on Day of Inspection

LVT Number: 9353

Tenants complained of inadequate heat and hot water building-wide. A DHCR inspector found that heat wasn't required because the outdoor temperature was above 55 degrees. The inspector also found that the water was hot enough. The DRA dismissed the complaint, and tenants appealed. They argued that inadequate heat and hot water was a recurrent problem, and submitted a complaint log as proof. The DHCR upheld the DRA's ruling. The temperature on the day of inspection was above 55 degrees, so the complaint about inadequate heat couldn't be investigated.

And the DHCR doesn't have to conduct more than one inspection to investigate a complaint. Also, tenants' log wasn't enough to negate the inspector's findings.
