Sweeping Twice Each Day Is Reasonable

DOS issued a violation notice to landlord for having a dirty sidewalk in front of her two-family house. Landlord claimed that she swept twice each day and that the house was located on a quiet street with little traffic. The ALJ ruled against landlord and fined her $50. Landlord appealed. ECB ruled for landlord and revoked the fine. Landlord made a reasonable effort to clean by sweeping twice each day. The house was on a quiet block and the violation notice stated that there was only a small amount of litter.
