Super Is Currently Exempt from Rent Control

LVT Number: #22020

Landlord's building super asked the DHCR to rule on her rent-control status. In 1952, she moved into the apartment with her parents, who were rent-controlled tenants. In 1974, her father became the building super. In 1977, her parents moved out of the apartment. Her husband became the super in 1977, and she was now the super. The DRA dismissed the super's request without making a ruling. She appealed. The DHCR dismissed the PAR. The super was currently temporarily exempt from rent regulation because she worked in the building and did not pay rent.

The super was currently temporarily exempt from rent regulation because she worked in the building and did not pay rent. Since there was no question about her present status, it would be premature for the DHCR to rule on whether she would be rent controlled in the future.
