Subtenant Not Entitled to Jury Trial

(Decision submitted by Nativ Winiarsky of the Manhattan law firm of Kucker Kraus & Bruh, LLP, attorneys for the landlord.) Landlord sued to evict tenant for nonpayment of rent. Subtenant demanded a jury trial. The court ruled against subtenant. Since there was a jury waiver clause in tenant's lease, subtenant was bound by this lease provision between landlord and tenant and wasn't entitled to a jury trial.
