Off-Street Parking

Tenants complained of a reduction in building-wide services based on landlord's discontinuation of off-street parking in the yard at the building. The DRA ruled for tenants. Landlord appealed, claiming that parking in the yard at the building was illegal. The DHCR ruled against landlord. Landlord used the yard to park his own car and employees' cars, tenants had parked in the yard for 40 years, the building's C of O stated that parking wouldn't violate usage or zoning regulations, and landlord's architect's opinion that parking was illegal was unsupported by other evidence.
