Storefront Apartment Violates C of O

DOB issued a violation notice to landlord because landlord permitted one of two stores on the first floor to be occupied as an apartment. Landlord claimed that no one actually lived in the unit and that it was used as storage for a taxi cab business. The ALJ ruled against landlord and fined him $800. Landlord appealed and lost. The store contained a full kitchen and bathroom, in violation of the C of O. It didn't matter that no one actually lived in the unit.
