Stairway Reconfiguration Doesn't Qualify as MCI

The DRA denied landlord's MCI rent increase application based on new stairs to the building basement and drain relocation. Landlord appealed and lost. Landlord claimed that the stairs were reconstructed and reconfigured, and that the drain relocation was necessitated by the stair reconfiguration. But the DRA found that the work was ordinary repair and maintenance that didn't qualify as an MCI. The reconfiguration of an exterior stairway doesn't qualify as an MCI.
