Staircase Repaired, Not Replaced

Landlord applied for MCI rent hikes, based on the installation of steel stairs. Tenants claimed that landlord hadn't installed a new staircase, but had just replaced some parts of the old one. The DRA granted the MCI increase, and tenants appealed. The DHCR revoked the rent hike. A DHCR inspection revealed that the staircase wasn't completely replaced---it was only repaired. Staircase repairs don't qualify for MCI rent hikes.
