Space Reduced Because of Pipe Installation

Landlord asked the DHCR for permission to reduce the amount of space in tenants' apartments by a small amount as part of repiping work in the building. The DRA ruled for landlord, but permanently reduced tenants' monthly rents by $6.00. Landlord appealed, claiming that the reduction in apartment space was minor and that no rent reduction was warranted. The DHCR ruled for landlord in part. The reduction in space wasn't minor. But the DHCR reduced the rent cut to $4.00 per month, and after a court appeal by landlord, to $2.00 per month.
