Son Also Claims Succession Rights After Daughter Gets Apartment

The daughter of rent-controlled tenants claimed succession rights to the apartment after tenants died. The DRA ruled for the daughter, finding that she had succession rights. The son then filed a PAR, seeking a right to intervene and to be named a co-successor.  The daughter objected, claiming that he lived in New Jersey.  The DHCR dismissed the PAR without ruling on the merits. The daughter wasn’t required to join the son as a party to her application for succession rights. The son could start a separate proceeding seeking succession rights for himself.

Since he wasn’t a party to the daughter’s case, there was no basis for him to appeal the DRA’s decision concerning the daughter’s succession rights.
