Small Area of Peeling Paint

Tenant complained of reduced services, claiming that water was leaking through the dining and living room walls. A DHCR inspector found a small area of peeling paint above the living room window and in a corner of the dining room. The inspector stated that these defects were ''minor,'' and noted that the exterior of the building in the area of the apartment had been pointed to prevent leaks. The DRA dismissed tenant's complaint. Tenant appealed, claiming that landlord hadn't corrected the defects. The DHCR again ruled for landlord.

The DRA can rule that minor defects found by the inspector don't warrant a rent cut. Also, landlord immediately complied with DHCR orders to correct the defects.
