Service Reduction Order Bars Landlord from Collecting MCI Increase

The DHCR granted landlord's application for MCI rent hikes. But the DHCR barred landlord from collecting the increases because of an outstanding building-wide rent reduction order based on reduced services. Landlord appealed the MCI order. The court ruled against landlord, and landlord appealed again. The appeals court also ruled against landlord. The DHCR's ruling was reasonable and precisely applied the laws and agency procedures governing such rent increases.
