Roommate of Rent-Controlled Tenant Replaced

Landlord applied for a rent increase based on an increase in the number of nonfamily adult occupants in rent-controlled tenant's apartment. The DRA ruled against landlord because tenant's initial 1969 rent included a charge for a roommate. Landlord appealed. Tenant's current roommate wasn't the same person as his original roommate. Replacement of a roommate was grounds for an additional increase in the maximum rent under rent control. It is considered an increase in occupancy. Tenant's rent was increased by 10 percent.
