Rooftop Solar Panels Installed Before Plans Approved

The Fire Department issued violation notices to landlord for failing to provide unobstructed rooftop access and failing to obtain prior approval for installation of solar equipment on the roof of three buildings. Despite landlord’s objections, the ALJ fined landlord $2,850. Landlord appealed and lost. Landlord had submitted plans for the solar panels, which the Fire Department eventually approved. But the plans hadn’t been approved at the time the violations were issued, and therefore, the penalties were proper.
