Landlord applied for MCI rent hikes based on a new roof installation. The DRA ruled against landlord because there was evidence of water leak stains in the roof bulkhead ceiling on the sixth floor of the building. Landlord appealed, claiming that the work was done properly. The DHCR ruled for landlord. An inspection had found no proof of any current leak in the ceilings of the hallway or bulkhead. And the DHCR's inspector had reported that the roof installation was done in a workmanlike manner. And none of the sixth-floor tenants were found to have any leaks in their apartment ceilings.
