The Department of Health issued violation notices to landlord of an SRO hotel based on 10 findings of roach infestation in common areas and individual rooms. Landlord objected. The ALJ ruled against landlord and fined her $100 for each condition. Landlord appealed, claiming that the building manager was an exterminator and that every Saturday, extermination was done in the public areas. At that time, the manager knocked on tenant's doors and performed extermination services in any apartment where access was permitted. ECB ruled against landlord.

Since the inspector found so many individual instances of roach infestation in tenant's rooms, landlord couldn't have been making adequate efforts to regularly inspect and exterminate.
