Resurfacing of Parking Area Qualifies

Landlord applied for MCI rent hikes based on the resurfacing of a parking area outside a building and related work. The DRA ruled against landlord. Landlord appealed and won. Under the TPR, as amended in December 2000, an MCI rent hike is allowed for resurfacing of a parking area when it is done in connection with the resurfacing and/or replacement of all exterior pedestrian and vehicular surfaces within the building's property lines. The owner did so in this case and so was entitled to an MCI rent hike.
