''Respondent'' No Longer Managed Building

DOB issued a violation notice to landlord for not maintaining an elevator. Solil Management, the managing agent named as the ''respondent'' on the violation notice, claimed that the building had been sold before the date on the violation notice and that it didn't work for the new landlord. The ALJ ruled for Solil and dismissed the violation. DOB appealed, claiming that there was insufficient proof that Solil was no longer the managing agent. ECB ruled against DOB. The ALJ found the managing agent's statements to be believable. Solil wasn't required to submit further documentary proof.
