Replacement Refrigerator Offered

Tenant complained of a reduction in services based on a defective refrigerator. The DRA ruled for tenant and reduced his rent. Landlord appealed, claiming that it had offered tenant a replacement refrigerator, which tenant refused to accept. An inspection showed that the replacement refrigerator was slightly different in size and shape from tenant's prior appliance and was an older machine. The DHCR ruled for landlord and revoked the rent reduction. Landlord's replacement refrigerator was comparable and was in good working order.
