Replacement Refrigerator Inoperative

Rent-stabilized tenant complained of a reduction in services because his refrigerator was inoperative. The DRA ruled for tenant and reduced his rent. Landlord appealed and lost. Landlord claimed that it delivered a replacement refrigerator to tenant, who wouldn't permit landlord to install it because it wasn't new. But the DHCR had conducted a no-access inspection. The inspector plugged in the replacement appliance, waited 25 minutes, and found that the refrigerator wasn't cool and the internal fan didn't start. Landlord's PAR was denied.
