Replacement of Hallway Flooring

Landlord applied for MCI rent hikes based on several improvements. The DRA ruled for landlord, in part, but denied any rent increase for the replacement of hallway flooring. Landlord appealed, claiming that the work performed consisted of removing the entire old floor, rather than repairing it. The DHCR ruled against landlord. Like painting, the replacement of carpeting or floor tiles is nonstructural work, primarily cosmetic in nature. It doesn't constitute an MCI.
