Replacement of Fence with Shorter Fence

The DRA ruled for landlord, and tenant appealed. Tenant claimed that a high vertical fence that landlord had removed had been replaced with a low fence with horizontal slats. Tenant claimed that people threw garbage over the low fence. The DHCR ruled against tenant. An inspection showed that a fence was now provided in front of the building. Landlord had restored services in compliance with the DRA's order.
