Repairing Vandalism Damage

Tenant complained of a rent overcharge. The DRA ruled for tenant, and landlord appealed. Although the DRA allowed some rent increase for apartment improvements, the DRA disallowed any increase for work done to repair severe vandalism damage to the apartment. The work involved patching holes, compounding, repairing glass, repairing fixtures and cabinets, and removing abandoned furniture. The DHCR ruled against landlord. This was repair work, not apartment improvements. So it didn't qualify for a 1/40th rent increase.
