Rents Restored for Apartments with Restored Intercom Service

The DRA ruled for tenants and reduced their rents based on DHCR inspection finding intercom problems in 15 apartments. Landlord later filed an application to restore rents based on the restoration of services. The DRA ruled against landlord, who appealed and won in part.

Tenants complained of a reduction in building-wide services based on a defective intercom system. The DRA ruled for tenants and reduced their rents based on DHCR inspection finding intercom problems in 15 apartments. Landlord later filed an application to restore rents based on the restoration of services. The DRA ruled against landlord, who appealed and won in part. DHCR inspection in response to the rent restoration application indicated that intercom service was restored in some apartments, that some tenants didn't give access for reinspection, and that one apartment intercom still wasn't working. The DHCR ruled that, except for the one apartment where inspection had confirmed a nonworking intercom, rents were restored effective Oct. 1, 2011, which was the first rent payment date following service of the rent restoration application on affected tenants.
