Rent-Stabilized Tenant's Grandson Gets Apartment

Rent-stabilized tenant's grandson claimed succession rights and complained that landlord refused to give him a renewal lease after tenant died. The DRA ruled for tenant's grandson. Landlord appealed and lost. Landlord didn't question that the occupant had lived in the apartment for a long time with tenant before she died. But landlord claimed there was no proof that the occupant was tenant's grandson. The DHCR pointed out that the grandson had submitted proof to the DRA, which included the birth certificates of tenant, her son, and the complainant.

But landlord claimed there was no proof that the occupant was tenant's grandson. The DHCR pointed out that the grandson had submitted proof to the DRA, which included the birth certificates of tenant, her son, and the complainant. The grandson's uncle also had submitted a letter to the DRA with his own birth certificate showing that he also was tenant's son, and a statement that the complainant was tenant's grandson. The uncle also stated that the grandson had lived in the apartment with tenant almost his entire life and took care of tenant toward the end of tenant's life.
