Rent-Stabilized Tenant Overcharged Series of Roommates

Landlord sued to evict rent-stabilized tenant for profiteering. Landlord claimed that tenant collected rent overcharges from a series of roommates over several years. The court ruled for landlord. Tenant appealed and lost. Evidence showed that tenant placed at least seven advertisements for roommates over a three-year period. Tenant admitted to having at least four roommates. Two of them were charged more than the entire legal rent for the apartment. The trial court properly ruled that tenant could be evicted for profiteering.
