Rent-Stabilized Apartment Was Lawfully Deregulated in 2015

Tenant complained of rent overcharge and improper apartment deregulation. The DRA ruled against tenant, who appealed and lost. Tenant moved into the apartment in June 2015. Prior tenant's lawful rent was $1,993 per month. The rent was increased by a 19 percent vacancy increase, a longevity increase of 9.6 percent, and an IAI rent increase of $167, representing 1/60th of a $10,000 improvement cost. The resulting vacancy rent was more than $2,500 per month, even without adding the IAI rent increase, and landlord therefore lawfully deregulated the apartment.
