Rent Reduction Order Applies to 32 Tenants Who Filed Complaint

Tenants complained of a reduction in building-wide services. The DRA ruled for tenants and directed restoration of services. But the DRA granted a rent reduction to only three of the 32 tenants who filed the complaint. Tenants appealed. Tenants had complained of elimination of a freight elevator, a defective first-floor window, and other common area conditions. Landlord claimed that all conditions were repaired. The DRA then asked tenants to respond to landlord's answer. Only three did so.

The DRA then asked tenants to respond to landlord's answer. Only three did so. But the complaint was filed by a tenants' representative, with accompanying signatures from the 32 tenants. And an inspection showed that the freight elevator and window conditions still existed. The DHCR ruled for tenants. All 32 tenants were entitled to a rent reduction.
