Rent Reduction for No Cooking Gas Revoked

Rent-stabilized tenant complained of a reduction in services in his apartment. The DRA ruled for tenant and reduced his rent based on various conditions, including the fact that there was no cooking gas service. Landlord appealed and won. Landlord argued that cooking gas service should be removed from the list of services not being maintained. The DHCR agreed. Landlord said that all apartments at the building had electric stoves and ovens, and that cooking gas wasn't in use. The DHCR's inspection report noted that the stove wasn't red-tagged, which would have indicated that Con Ed shut off gas service. Tenant didn't rebut landlord's claim. Cooking gas was removed from the list of services not being maintained.
