Rent Ledgers Used to Complete Rental History

(Decision submitted by Benjamin Binder of the Manhattan law firm of Shaw & Binder, attorneys for the landlord.) Tenant complained of a rent overcharge. The DRA ruled for tenant based on landlord's default, finding that landlord didn't submit a complete rent history in response to tenant's complaint. Landlord appealed and won. Landlord had submitted to the DRA rent ledgers for some periods where leases weren't available. The rent ledgers showed the June 30, 1974, base date. There was no rent overcharge.
